ARTICLE 1 — GENERAL PROVISIONS

These General Terms and Conditions of Sale ("GTC") apply exclusively to the online sale of products offered by ECOM TRENDS GROUP LIMITED ("the Operator") on the website rcxbuggy.com. The GTC are made available to customers on the Site. By ticking the box or clicking the validation button, the Customer acknowledges having read and accepted them before placing an order. Validation of the order implies full adherence to the GTC in force on the day of the order.

ARTICLE 2 — PRODUCT DESCRIPTION

The Site is an online store for RC vehicles, buggies, and leisure/hobby products ("Product(s)"). Each product is accompanied by a description mentioning its essential characteristics. Photographs are not contractual. Products comply with the applicable laws in the European Economic Area (EEA).

ARTICLE 3 — CUSTOMER ACCOUNT

To place an order, the Customer may be required to create a personal account. The Customer is responsible for maintaining the confidentiality of their login credentials. ECOM TRENDS GROUP LIMITED reserves the right to suspend any account in the event of fraudulent use or breach of these terms.

ARTICLE 4 — ORDERS & AVAILABILITY

Orders are subject to stock availability. If a Product becomes unavailable after an order is confirmed, the Operator will inform the Customer by email. The Customer may then choose:

  • Delivery of an equivalent product.

  • A full refund within thirty (30) days.

The Operator reserves the right to refuse any order for legitimate reasons (e.g., existing dispute, payment incident, or suspicious activity).

ARTICLE 5 — PAYMENT AND SECURITY

The Customer expressly acknowledges that any order placed on the Site implies an obligation to pay.

Payment Methods: Payments are processed via secure solutions (Stripe and/or PayPal). We accept major credit cards (Visa, Mastercard, Amex).

Security: Banking details are encrypted via SSL (Secure Socket Layer) and are never stored on the Operator's servers.

Taxes: ECOM TRENDS GROUP LIMITED is incorporated in Hong Kong. Prices are displayed as net totals. Customs duties or local taxes may apply depending on the Customer's country of delivery.

ARTICLE 6 — INTERNATIONAL SALES & CUSTOMS

For any order delivered outside the country of dispatch (notably to the European Union, United Kingdom and the United States):

  • The Customer is the importer of record.

  • Customs duties, local taxes, or import duties may be applicable. These costs are not included in the price paid to the Operator and are the sole responsibility of the Customer.

  • The Operator is not responsible for delays caused by customs clearance.

ARTICLE 7 — DELIVERY

Areas: We deliver to the United Kingdom, United States of America, United Arab Emirates, Qatar, Saudi Arabia, France, Belgium, Switzerland, Germany, Netherlands, Sweden, Italy, Poland, Austria, Denmark, Spain, and Portugal.

Delays: Products are shipped according to the times indicated on the site (estimated 4–6 business days).

Transfer of Risk: Risk of loss or damage passes to the Customer upon physical possession of the Product.

ARTICLE 8 — RIGHT OF WITHDRAWAL (RETURNS)

In accordance with EU and UK consumer laws, Customers have 14 days from receipt to exercise their right of withdrawal.

Exceptions: The right of withdrawal does not apply to goods that have been unsealed after delivery and cannot be returned for hygiene or health protection reasons.

Process: Returns must be sent in original packaging and perfect condition. Return shipping costs are borne by the Customer.

ARTICLE 9 — LEGAL GUARANTEES

Regardless of any commercial warranty, the Operator remains liable for:

  • Legal Guarantee of Conformity: (2 years for EU residents).

  • Guarantee against hidden defects: As per applicable sale of goods laws and EU directives.

ARTICLE 10 — INTELLECTUAL PROPERTY

All elements of the Site (texts, logos, images, software) are the exclusive property of ECOM TRENDS GROUP LIMITED. Any reproduction or use without prior written authorization is strictly prohibited.

ARTICLE 11 — GOVERNING LAW AND DISPUTES

Amicable Settlement: In case of a dispute, contact contact@rcxbuggy.com first.

Mediation: EU customers can access the Online Dispute Resolution (ODR) platform: http://ec.europa.eu/consumers/odr/.

Jurisdiction: Failing an amicable solution, the competent courts shall have jurisdiction, without prejudice to mandatory consumer protection laws in the Customer's country of residence.
